Overtime Lawsuits

A recent article in WorkForce, a Human Resources magazine, wrote about a number of very high profile cases involving companies settling lawsuits. These resulted from suits involving the incorrect catagorization of employees as exempt or non-exempt. Large numbers of employees were incorrectly classified as exempt (not eligible for overtime)when they should have been classified as non-exempt employees, thus receiving overtime pay. Employment attorneys will tell you this violation of the Fair Labor Standards Act is one of the most common committed by companies.
